CallInstall Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the CallInstall platform — the web application at dashboard.callinstall.co.za, the CallInstall technician mobile application, and the guest task links we issue (together, the "Platform"). The Platform is operated by Call Install Solutions (Pty) Ltd, registration number 2026/145832/07, of 8 Fairbairn Street, Worcester, Worcester, Western Cape, 6850 ("CallInstall", "we", "us").

By clicking "Agree & continue", or by accessing or using the Platform, you accept these Terms. If you do not agree, you may not use the Platform.

1. Definitions

  • "Client Organisation" — a business registered on the Platform that creates Service Tasks for work it needs done.
  • "Service Provider Organisation" — a business registered on the Platform that supplies Technicians to perform Service Tasks.
  • "Technician" — an individual who performs Service Tasks, whether employed or engaged by a Service Provider Organisation or operating independently.
  • "Guest Technician" — an individual without a Platform account who accesses a single Service Task through a secure guest link and PIN.
  • "User" or "you" — any person who accesses the Platform, including users of Client Organisations, Service Provider Organisations, Technicians, and Guest Technicians.
  • "Service Task" — a request for installation or related services created on the Platform.
  • "Quote" — a priced offer submitted through the Platform in relation to a Service Task.

2. Acceptance and eligibility

2.1 You must be at least 18 years old to use the Platform.

2.2 The Platform is provided for business use. If you accept these Terms on behalf of an organisation, you warrant that you have authority to bind that organisation, and "you" includes that organisation.

2.3 We may update these Terms from time to time. Each version is identified by its version date. When we publish a new version, you will be asked to accept it before continuing to use the Platform. The version you accepted, and when, is recorded.

3. Accounts

3.1 Platform accounts are created by invitation only — by CallInstall or by an administrator of your organisation. You may not share, sell, or transfer your account.

3.2 You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@callinstall.co.za if you suspect unauthorised use.

3.3 You must provide accurate, current information (including your name, contact details, and, for Technicians, professional information) and keep it up to date.

3.4 Organisation administrators are responsible for the users they invite, for assigning appropriate roles, and for deactivating users who leave their organisation.

4. The Platform and our role

4.1 The Platform enables Client Organisations to create Service Tasks; matches and assigns those tasks to Service Provider Organisations and Technicians; manages quoting, approval, job execution, and evidence capture; and supports invoicing for completed work.

4.2 CallInstall operates and coordinates the Platform. The physical work described in a Service Task is performed by Service Provider Organisations and Technicians. [ATTORNEY REVIEW: confirm whether CallInstall contracts as principal for the work or as facilitator between the organisations — this clause and clauses 11–13 depend on it.]

4.3 We do not guarantee that any Service Task will be accepted, that a Technician will be available, or that any particular Quote will be offered or approved.

5. Quotes, invoicing and payment

5.1 Pricing on the Platform is quote-based. Quotes submitted through the Platform are offers that become binding on approval through the Platform's quote-approval workflow.

5.2 A Service Task is only complete once the required approvals and completion evidence (including photos and, where required, a customer signature) have been captured through the Platform.

5.3 Invoices relating to Platform work are processed through our accounting systems, which include Xero. Invoice and payment terms (including payment periods) are as stated on the relevant invoice or as separately agreed with your organisation.

5.4 The Platform does not currently process payments. If in-app payment processing is introduced, additional terms will apply and you will be asked to accept an updated version of these Terms.

6. Technician obligations

6.1 Technicians must perform Service Tasks with reasonable skill and care, comply with applicable law and safety standards, and hold any licences or certifications the work requires.

6.2 When starting a job, the Platform verifies the Technician's device location against the job site. Technicians must not falsify location, photos, signatures, or any other job evidence. Where an organisation has enabled on-site location enforcement, a job cannot be started away from the site.

6.3 Job evidence (before/after photos, customer signature) must be captured honestly and only as required to record the work performed. Photos must not include people except as strictly necessary, and customer signatures must be given by the customer themselves.

7. Guest Technicians

7.1 A guest link grants access to a single Service Task only, protected by a PIN, and expires. You may not share a guest link or PIN with anyone else.

7.2 Before submitting any information through a guest link, you will be asked to accept these Terms and acknowledge the Privacy Policy. Clauses 6 (Technician obligations), 8 (Acceptable use), and 11–13 apply to Guest Technicians as they apply to Technicians.

8. Acceptable use

You may not: (a) use the Platform for any unlawful purpose; (b) misrepresent your identity, role, or organisation; (c) access or attempt to access data or functions your role does not permit; (d) interfere with, probe, or disrupt the Platform or its security; (e) scrape, copy, or extract Platform data other than your own organisation's data through the interfaces provided; (f) circumvent the Platform to avoid quoting, evidence, or invoicing workflows for work originated through the Platform; or (g) upload content that is unlawful, infringing, or malicious (including malware).

9. Intellectual property

9.1 The Platform, its software, design, and branding are owned by CallInstall or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Platform for your organisation's internal business purposes while these Terms apply.

9.2 Your organisation retains ownership of the data it submits. You grant CallInstall a licence to host, process, display, and transmit that data (including job photos and signatures) as needed to operate the Platform and provide the service.

10. Confidentiality and data visibility

10.1 Information visible to you on the Platform (including task details, customer details, and pricing) is confidential. You may use it only for performing your role on the Platform and may not disclose it except as required by law.

10.2 The Platform enforces role-based visibility (for example, quote and pricing data is not visible to task-management roles). You must not attempt to obtain information your role does not expose.

10.3 Personal information is handled as described in our Privacy Policy, which forms part of these Terms.

11. Disclaimers

11.1 The Platform is provided "as is" and "as available". To the extent permitted by law (including the Consumer Protection Act 68 of 2008 where it applies), we do not warrant that the Platform will be uninterrupted, error-free, or secure, and we exclude all implied warranties.

11.2 Subject to clause 4.2, CallInstall is not responsible for the workmanship, conduct, or compliance of Service Provider Organisations or Technicians, nor for the accuracy of information submitted by other Users.

12. Limitation of liability

12.1 To the extent permitted by law, CallInstall's total liability arising out of or in connection with the Platform in any 12-month period is limited to the greater of (a) the fees paid by your organisation to CallInstall in that period and (b) R10,000.

12.2 To the extent permitted by law, CallInstall is not liable for indirect, consequential, or special damages, loss of profits, loss of business, or loss of data.

12.3 Nothing in these Terms excludes liability that cannot be excluded by law, including under the Consumer Protection Act where it applies to you.

13. Indemnity

To the extent permitted by law, you indemnify CallInstall against claims, losses, and expenses arising from your breach of these Terms, your misuse of the Platform, or (for Service Provider Organisations and Technicians) the performance of the physical work on a Service Task.

14. Suspension and termination

14.1 We may suspend or deactivate an account or organisation that breaches these Terms, compromises Platform security, or where required by law. Where reasonable, we will give notice and an opportunity to remedy.

14.2 Your organisation may stop using the Platform at any time. Clauses that by their nature survive (including 9, 10, 12, 13, and 16) survive termination. Data retention and deletion after termination are described in the Privacy Policy.

15. Changes to the Platform

We may change, add, or remove Platform features. If a change materially reduces the service your organisation receives, we will give reasonable notice.

16. General

16.1 These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.

16.2 If any clause is unenforceable, the rest of the Terms remain in force. Our failure to enforce a right is not a waiver of it.

16.3 These Terms, together with the Privacy Policy and any written agreement between CallInstall and your organisation, are the entire agreement regarding the Platform. If a signed agreement with your organisation conflicts with these Terms, the signed agreement prevails.
